ACTION: Tell the California Assembly Not to House Men in Women’s Prisons!

The Issue:

On June 25th, the California Assembly Committee on Public Safety will hold a hearing where it will hear arguments on S.B. 132, which has already passed in the state Senate. This bill would:

  • Require the Department of Corrections and Rehabilitation to, during initial intake and classification, ask each individual entering into the custody of the department to specify the individual’s gender identity, sex assigned at birth, preferred first name, gender pronoun, and honorific.
  • Require the department to issue identification to the person with a gender marker consistent with the gender identity the individual most recently specified.
  • Prohibit the department from disciplining a person for refusing to answer or not disclosing complete information in response to these questions.
  • Authorize a person under the jurisdiction of the department to update this information.
  • Require staff and contractors to consistently use the gender pronoun and honorific an individual has specified in verbal and written communications with or regarding that individual that involve the use of a pronoun or honorific.
  • Require the department, for a person who has a gender identity that differs from their sex assigned at birth, to only conduct a search of that person by an officer of the gender identity of the person’s preference, and to house the person in a correctional facility designated for men or women consistent with the incarcerated individual’s gender identity.

Samuel Little is a man who has confessed to murdering 93 women, and is currently housed in a CA men’s prison. If this bill succeeds, men like Samuel Little will be required to be housed in women’s prisons if they simply declare that they are women. Female prison guards will be forced to conduct searches of men’s intimate body parts. This is unacceptable.
